What is a lemon?
If your consumer product or appliance was sold to you or leased after January 1, 1987 and has a defect that substantially impairs its functionality, it is considered a "lemon" under state and federal law. Under Washington DC law, if a new motor vehicle does not conform to all warranties during the first 18,000 miles of operation or during the two year period following the initial purchase, whichever comes first, the consumer needs to report the defect to the manufacturer. It must require multiple repairs while under the manufacturer's factory warranty to qualify under state and federal Lemon Law and all repairs need to be made by the manufacturer, dealership, or other qualified diagnostic center deemed appropriate under the warranty.
It is not uncommon for a person to believe lemon laws only apply to motor vehicles. In reality, Lemon Law applies to all types of consumer products under federal law in accordance with The Magnuson-Moss Warranty Act, even if the state does not recognize them. Under federal law, used vehicles are also covered if you have a manufacturer's warranty, original or extended. These products include, but are not limited to, cars, trucks, SUVs, motorcycles, RVs/motor homes, boats, computers, and home appliances. There are certain specifications the product must meet, such as costing $25 or more and having a written warranty.
